Terms of Service

These terms apply to your use of the Order By The Case website and to every order you place with Order By The Case ("we", "us"). By using our website or placing an order, you agree to these terms.

1. What we sell

We sell supermarket products by the case only. Each product page shows the number of units in the case and the size of each unit. Product images are for illustration; packaging may vary.

2. Accounts

You are responsible for keeping your account details accurate and your login secure, and for orders placed through your account.

3. Prices and payment

Prices are in Canadian dollars and do not include applicable taxes, which are added at checkout. Delivery fees are set out in our Shipping Policy: $20.00 for orders under $75.00, $9.99 for orders from $75.00 to $299.99, and free from $300.00, based on your subtotal after discounts and before tax. There is no minimum order. We may change prices at any time, but the price shown when you place your order is the price you pay.

If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund you in full.

4. Orders and availability

Your order is an offer to buy. A contract is formed when we confirm your order. Products are subject to availability. If an item is unavailable, we will let you know and refund it, or offer a substitute only if you agree.

5. Delivery

We deliver locally only, to addresses with a postal code in the Greater Toronto Area or Greater Montreal. We do not ship anywhere else in Canada. Delivery fees, delivery times, carry-in and restocking are described in our Shipping Policy. Most items are delivered in 2 to 5 business days, and specialty items may take longer. We deliver Monday to Friday only, and you will get a text or email with your delivery day.

6. Dairy, Fridge & Frozen

Dairy, Fridge & Frozen products are sold only to approved business accounts. Someone must be there to receive them. We may cancel and refund an order for these products placed by any other customer.

7. Business accounts and invoice terms

Businesses can apply for 30-day invoice terms, subject to approval. Approval is at our discretion and may require business and credit information. If approved, we set a credit limit for your account at approval, and invoices are due within 30 days of the invoice date.

If an invoice is paid late, we may suspend your invoice terms until your account is up to date. We may also change or withdraw invoice terms with notice to you.

8. Returns and refunds

Returns, refunds, cancellations and reports of damaged, wrong or missing items are covered by our Refund Policy. In short: all sales are final, because we order products in just in time for each customer. If an item was damaged in our care, we sent the wrong item, or an item is missing, email us within 48 hours of delivery, with a photo, and we will make it right with a refund, a credit or a replacement, at our choice and at no charge to you. Other returns are not guaranteed; we may accept them case by case, and a return fee will be quoted. Perishable products cannot be returned unless we made a mistake.

9. Product information

We take care to describe products accurately, but ingredient, allergen and nutrition information can change. Always read the label on the product before use, especially if you have allergies or dietary needs.

10. Use of our website

You agree not to misuse our website, interfere with its operation or use it for any unlawful purpose. All content on the site belongs to us or our licensors.

11. Limitation of liability

To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms limits rights you have under applicable consumer protection law.

12. Privacy

Our Privacy Policy explains how we handle your personal information.

13. Governing law

These terms are governed by the laws of the province where your order is delivered (Ontario or Quebec) and the federal laws of Canada that apply there. If you are a consumer, you also keep the protection of the laws of the province where you live.

14. Changes to these terms

We may update these terms from time to time. Changes apply to orders placed after the updated terms are posted.
